In a move aimed at addressing the financial responsibility for dismantling wind turbine foundations, the Ministry of Infrastructure in Thuringia has enacted a new regulation. This regulation places the responsibility for dismantling the foundations, paths, and sealed areas of wind turbine facilities squarely on the operators.

Operators are now required to provide a security deposit of 6.5 percent of the investment sum for the dismantling costs, to be held until the end of the wind turbines' lifespan. The regulation, effective since late August, applies only to wind turbines erected after this date.

Thuringia currently operates approximately 900 wind turbines for power generation, and the expansion of these facilities has been proceeding slowly. Six new wind turbine facilities were put into operation by June 30.

The CDU state parliamentary fraction has welcomed this regulation, praising its clarity and elimination of legal ambiguities. Thomas Gottweiss, the CDU energy politician, explained that the regulation provides clarity as it eliminates the legal discretionary range in the Building Code Act.

However, the regulation does not seem to address the financial responsibility for the dismantling of wind turbines erected before its enactment. The Ministry of Infrastructure is responsible for enforcing this regulation, and it remains to be seen how they will handle this aspect.

According to Thomas Gottweiss, the entire foundation must be removed from the ground. The dismantling costs include the removal of the foundations, paths, and sealed areas. The companies or entities that constructed the wind turbines after August 2021 in Thuringia are responsible for the removal of their foundations.

The CDU state parliamentary fraction's statement suggests that the regulation addresses ambiguities in the Building Code Act. This regulation is a significant step towards ensuring the long-term environmental and financial sustainability of Thuringia's wind energy sector.
