When the loaned money was not returned, the woman initiated a lawsuit seeking the return of the amount, plus interest — nearly four million rubles. She presented evidence in the form of transfer receipts.
In contrast, the defendant asserted that he had no relations with the plaintiff and had never asked for a loan.
The first instance court rejected the lawsuit, arguing that the transfers alone were not substantial enough to prove a loan. The woman appealed the decision, but the regional court upheld the original verdict.
During the appeal, the true nature of the transfers was exposed. It was revealed that the plaintiff's husband was involved in the black-market sale of red caviar in 2021. He used his wife's card for these transactions. Moreover, the defendant's son provided his father's card for payment receipt of the caviar.
"The funds transferred from the plaintiff's card to the defendant's card were payments for the sale of unmarked caviar in illegal circulation, not loan funds. There is no basis for reversing the court decision or granting the lawsuit," the court elucidated.
