Pharmacist wins lawsuit after Noventi’s contract termination dispute fails in court

The Munich Regional Court I has dismissed a lawsuit brought by Noventi against pharmacist Joost Ney. The dispute, centered around approximately €6,100, stemmed from Ney's termination of his scotus with Noventi following fee increases.

Ney, who had been a Noventi customer since early 2021, switched to ARZ Haan after terminating the contract. Noventi sued Ney for breach of contractual obligations, claiming he had missed the deadline for termination.

The court, however, ruled in Ney's favor. It found that the fee adjustment entitled him to a special right to cancel the contract, and he had not missed the deadline. Noventi failed to prove that an email notifying Ney of the deadline had reached him, as claimed by the pharmacist. The court thus deemed Ney's termination valid, and Noventi had no claim to information or damages.

Noventi has declined to comment on the ongoing legal proceedings. The ruling remains subject to appeal, but for now, the pharmacist, Joost Ney, has been vindicated in his decision to terminate the contract with Noventi.
