Hearing for North Dakota's Permit Program on Coal Waste Disposal

The Environmental Protection Agency (EPA) recently held a public hearing for the approval of North Dakota's Coal Combustion Residuals (CCR) state permit program. The in-person hearing took place at the ND DEQ Building, 4201 Normandy Street, Room 223, Bismarck, North Dakota 58503, on July 8, 2025, from 9:00 am to 6:00 pm (Central Time).

The EPA announced the proposal to approve the North Dakota DEQ's application on May 12, 2025. The public hearing provided a platform for interested persons to voice their opinions about the EPA's proposal. The hearing was divided into several segments, including openings, breaks, and periods for public comments.

Registrations for the in-person hearing were closed, but the public hearing was also held online. Interested persons were given the opportunity to present information, comments, or views concerning the EPA's proposal at the public hearing. Public comments were accepted during specific time slots: from 9:10 am to 10:30 am, 10:45 am to 12:00 pm, 1:10 pm to 2:30 pm, 2:45 pm to 4:00 pm, and 4:15 pm to 6:00 pm (Central Time).

Scheduled breaks were at 10:45 am, 12:00 pm, 2:30 pm, 4:00 pm, and 4:15 pm (Central Time). A lunch break was also provided from 12:00 pm to 1:00 pm. If anyone has questions about the hearing, they can send them through a provided form.

The public hearing was part of a process where written comments were also accepted. For more detailed information and to submit comments, you can visit the EPA's official Coal Ash (Coal Combustion Residuals) webpage, where they provide updates, hearing details, and guidelines for submitting comments.

It's worth noting that the EPA also held an online public hearing for this proposal on September 12, 2025, in connection with revisions related to the state's CCR permit program. The Federal Register notice reopening the comment period (which closes August 26, 2025) provides more detailed information and guidelines for submitting comments on the proposal.

You can also review the comments from stakeholders such as the Association of State and Territorial Solid Waste Management Officials (ASTSWMO), which submitted comments supporting the EPA's proposed approval. For direct inquiries, you can find EPA contact information or FAQs on the EPA website related to coal ash regulations.

Thus, to participate or inquire further, you should access the EPA’s online platforms as they host public hearings, provide official notices, and collect public comments on regulatory actions.
