French VPN Services Directed to Bar Access to Unlawful Streaming Platforms - Inquiry into Implementation Methods

In a landmark decision, the Paris Judicial Court has ordered five prominent Virtual Private Network (VPN) providers - NordVPN, Surfshark, ExpressVPN, Proton VPN, and CyberGhost - to block access to over 200 illegal sports streaming sites within French territory. The ruling marks the first of its kind in treating VPNs as enforcers against piracy.

The case, initiated by French broadcaster Canal+ alongside the Ligue de Football Professionnel (LFP), targets unauthorized streams of high-profile sports events like the UEFA Champions League, Premier League, and Top 14 rugby matches. These events hold exclusive French broadcasting rights held by Canal+.

The VPN providers named in the case have expressed disappointment with the outcome, as being forced to restrict access to any sites - legal or otherwise - contradicts the fundamental principles of most VPN services. They argue that this sets a dangerous precedent for future legal cases and VPN targeting.

Technically, the providers may implement domain-level blocking, translating the likeliest technical approach. Many leading VPN providers operate their own Domain Name System (DNS) servers, which play a crucial role in translating domain names into the correct IP address for desired sites. In theory, illegal streaming sites could be added to the blocklist maintained by these providers.

Users within France or French territories may encounter disrupted access to certain pirate IPTV and sports streaming sites if VPN providers comply with the ruling. However, some providers, like NordVPN and Proton VPN, offer custom DNS servers as an option, allowing users to bypass these blocks. Surfshark recently launched a privacy-focused public DNS service as well.

The Internet Infrastructure (i2) Coalition and the VPN Trust Initiative (VTI), to which some of the VPN providers belong, have expressed concerns about the ruling. They argue that it risks the integrity of the internet, misplaces responsibility, and threatens the privacy and security of millions of users in France and beyond.

Denis Vyazovoy, CPO of AdGuard VPN, suggested that providers might choose to remove physical French servers and replace them with virtual servers elsewhere to maintain user levels in France while evading the blocking orders.

As the VPN providers weigh their responses, they face challenges in complying with the court order while preserving user privacy and trust in their services. Meanwhile, experts warn that this ruling could set a dangerous precedent for future legal cases and VPN targeting, as well as potentially limiting digital freedoms.
