Federal lawmakers sanction prolongation of rent price cap
Say goodbye to skyrocketing rents, 'cause the rent control measure is here to stay! The German Bundestag has given the green light to extend this tenant-friendly law until the end of 2029, much to the delight of the justice minister, Stefanie Hubig.
According to Hubig, tenants deserve protection against unpredictable rent hikes. She pointed out that the newly agreed plans for tenancy law also include index-linked rents and furnished apartments. With nearly two-thirds of Germans renting their homes, this move surely brings some relief.

While the extension of the rent control measure seems like a breath of fresh air for tenants, it's a different story for some critics. CDU/CSU parliamentary group's housing policy spokesperson, Jan-Marco Luczak, warns that high rents in major cities are a significant burden, even for the middle class. He adds, "With the extension of the rent control measure, we are now giving people security and time to breathe."
However, Luczak stresses the importance of expediting housing construction in Germany to combat this issue effectively.
Will Rent Control Hindrance Construction?
Introduced in 2015, the rent control measure sets a maximum of 10% above local average rents for new tenancies in tight housing markets. As we move past 2025, state governments will be able to determine these tight housing market areas through ordinances.

Critics argue that the rent control measure discourages new construction projects, pointing to a decline in building permits and completions. They also highlight that this measure mainly benefits those already living in apartments, neglecting those still searching for one. Furthermore, it's not targeted, offering protection to all, from chief physicians to nurses equally.

Left critics labeled the rent control measure as ineffective, calling it a "toothless tiger." They argue that exceptions for furniture, living on time, and comprehensive modernization remain in place. Moreover, they lament the lack of penalties for violations, making it easy for landlords to circumvent the rent control measure.
However, it's important to note that newly built apartments first rented out after October 2014 are exempt from the rent cap to encourage construction.
