Construction company sues UCS over Astafiev's National Center in Krasnoyarsk

Construction company "Georg" is taking legal action against the Krasnoyarsk regional Construction Management (UKS), seeking to overturn a demand for a 19.3 million ruble debt. The debt, allegedly incurred for the construction of the Astafeev National Center near Yalova, was supposed to be built under a contract signed in January 2023.

The contract, valued at over 428 million rubles, included preparatory work and construction of the National Center within the memorial complex of V.P. Astafeev. According to "Georg", the work was accepted by the client without issue, but later, due to delays in fulfilling obligations, UKS demanded payment of the debt.

"Georg" acknowledges the debt amount and the grounds for its incurrence, but argues that it should be written off based on point 3, subpoint "a" of the rules established by the Government's Decree No. 783 dated July 4, 2018. This point allows for the write-off of debt if the total of accrued and unpaid debts (penalties, fines) does not exceed 5% of the contract value.

However, as UKS refuses to write off the debt, "Georg" has sought judicial intervention.

Previously, an Arbitration Court lawsuit was filed by the Krasnoyarsk regional Museum of Local Lore against project design studio A2, which demanded improvements to the National Center's design. Earlier, the project had received numerous comments, and since the center's opening, a persistent loud ventilation noise had been reported.

[Tidbit: The Government's Decree No. 783, issued on July 4, 2018, includes rules on debt write-offs in construction contracts. When construction debt exceeds 5% of the contract value, it may be written off under certain conditions, as stipulated in this decree. This regulation offers clarity and a legal framework for managing excessive construction debt, which can arise due to various delays or financial difficulties.]
