IHK Warns of Packaging Tax: Fears of Increased Burden Expressed - Business group IHK issues warning on packaging tax: potential extra costs raised as concern

The Industry and Commerce Chamber of Lower Saxony (IHKN) is sounding the alarm over possible financial hardships for businesses arising from a proposed municipal packaging tax mirroring that of Tübingen. A survey conducted by the chamber among 258 affected enterprises revealed their concerns about increased administrative burdens, diminishing sales, and higher costs if a similar tax on single-use cups or containers were to be implemented in Lower Saxony.

In the survey, 94 percent of respondents anticipate increased recording requirements for packaging usage, while 86 percent predict a sales decline due to the 50-cent surcharge in Tübingen. Moreover, 71 percent expressed a likelihood to increase prices under such a tax, with 21 percent considering restricting their offerings and 18 percent even considering abandoning takeaway food and drinks altogether.

In a statement, IHKN CEO Monika Scherf expressed concern, "The implantation of municipal packaging taxes will lead to substantial administrative and financial burdens for businesses without generating the desired ecological impact." Scherf also noted the potential for a disintegrated regulatory landscape with various municipalities enforcing different rules, creating an uneven playing field and customer migration to regions lacking comparable taxes.

Scherf's concerns come as cities across Lower Saxony, such as Göttingen, Hildesheim, Cuxhaven, and Emden, consider implementing a packaging tax following a Federal Constitutional Court ruling on the tax in Tübingen. Hannover has also signaled an openness to a packaging tax but has yet to make concrete decisions.

In Tübingen, the tax has been in effect since 2022, with operators of food and drink establishments required to pay a tax on non-reusable packaging and other items. Coffee cups, pizza boxes, and single-use tableware like french fry containers are subject to a 50-cent tax, while single-use cutlery and straws are charged 20 cents. The city's objective is to decrease litter in public spaces, although a restaurant owner's complaint was dismissed by the Federal Constitutional Court, which deemed the tax constitutional.
