Bangladesh's Judiciary Fortifies Environmental Rights
Bangladesh's legal landscape has seen significant developments in environmental protection, with the judiciary playing a pivotal role. Key cases have established the state's obligation to preserve natural resources and the environment, while also broadening access to justice for vulnerable groups.
In 'Bangladesh Environmental Lawyers Association v Bangladesh and others' (Writ Petition No 4098 of 1999), the court underscored the state's responsibility to safeguard the environment for both present and future generations. This ruling echoed the constitutional provision in Article 18A, which mandates environmental conservation and preservation. The Bangladesh Environmental Lawyers Association (BELA), a non-profit organization dedicated to environmental advocacy, filed this landmark case, marking a significant milestone in Bangladesh's environmental law evolution.
These judicial interventions have been instrumental in safeguarding Bangladesh's environment. However, stronger environmental policies and laws are urgently needed to complement these efforts and ensure sustained protection.
