Augsburg customs office taking responsibility for fair pay evaluations/Overseeing federal minimum wage compliance

The Main Customs Office Augsburg recently carried out a focus inspection on black work and illegal employment, targeting various industries such as catering and hotels, construction, logistics, kiosks, and fitness studios. Over 150 people were questioned at 70 inspection objects or companies.

The inspection aimed to ensure compliance with the minimum wage, which is currently set at 12.82 euros gross per hour, effective from January 1, 2025. The Main Customs Office Augsburg conducts these inspections as part of its tasks.

During the inspections, the Financial Control Schwarzarbeit (FKS) of the Main Customs Office Augsburg, comprising around 90 employees, uncovered various tactics used to conceal minimum wage violations. For instance, employees were sometimes referred to as trainees, apprentices, or self-employed to bypass minimum wage regulations. Incorrect, incomplete, or non-existent recording of hours was also a common tactic.

The FKS inspections contributed to the detection and punishment of violations. As a result, two criminal proceedings and two cases of illegal stay of Mongolian nationals were initiated on site. Four administrative offence proceedings were also initiated. Moreover, in around 60 cases, further in-depth investigations are necessary.

Coordinated inspections by the FKS are an important tool for reducing the social acceptance of black work and illegal employment. They help to ensure fair working conditions for all employees and contribute to the fair competition among businesses.

The authorities emphasise that agreements below the minimum wage are invalid and punishable. They remind employers that it is their responsibility to ensure compliance with labour laws.
